what is Permanent Patent Application?
A patent is a legal right given to the patentee to prohibit all others from using, making or selling the invention for a certain period of time, which is usually 20 years. Additionally, after the patent is registered, the inventor discloses the invention in the public domain so that it is free for all others to use when the patent expires.
A patent registration helps to secure the monopoly of the innovation and also creates an intangible asset for the patentee. The holder of the patent or the patentee is entitled to file a lawsuit against any body who violates the patent.
What is Patentable?
For a Valid Patent, an invention:
Should involve an inventive step
Should be capable of industrial application
Must be Novel / New. An invention is novel if it does not form part of the state of the art. The state of the art comprises everything made available to the public, anywhere in the world, by means of a written or oral description, by use, or in any other way, before the date of filing of the patent application.
Benefits of Patent Registration
EXCLUSIVE RIGHT OVER INVENTION
Patent registration provides the patentee with an exclusive power to prohibit all others to make, use, or sell the patented invention without permission. The patentee holds an exclusive right to sue any body who tries to violate the patent.
Builds Goodwill in the market
If an invention is patented, it directly improves the brand value of the company who owns it. The same company can charge the consumers higher value for the product that has the innovation which is patented.
Monetisation
Patent is one of the most valuable intangible asset that a patentee holds. If managed intelligently, a patentee can monetize over his patent by licensing, assigning or selling the patent whenever needed. Monetization is very common in the pharmaceutical industry where companies make huge profits by licensing, assigning their patent to other companies.
