      what is Provisional Patent?

      A patent is an exclusive legal right of the inventor/patentee that grants him the legal authority to prohibit others from making or using a patented invention. Filing a provisional patent application is very useful to the inventor as it helps the inventors to lock the priority date and secure the invention so that no one else can claim authority over it.

      A provisional patent application is a brief description that gives a summary and the essence of the invention before filing for the final application encompassing complete specification of the invention.

      An invention is not patentable if:

       

       

      It is a theory whether scientific or mathematical

      It is an aesthetic/graphical creation including literary, artistic, dramatic, work

      A scheme for how to perform an act

      Benefits of Filing a Provisional Patent Application:

      Creates Priority Rights

      Filing a provisional patent application, helps the applicant to lock the priority date for the patent and hence secure the invention so that no one else can claim authority over it.

      Allows more time to make required changes

      Filing a provisional patent allows a time of 12-months to file the final patent application. In the 12-month period, the applicant can work on his invention and find its unique utility and novelty.

      Measure the actual value of the invention

      In the 12-month period allotted after the provisional application, the applicant can actually measure the value of the invention and contemplate whether the invention has enough potential to be patented. Changing the decision in the 12-month does not attract any charges or penalties and the applicant can thoughtfully decide if the investment to register the patent is worth it.
