what is a Show Cause Notice (SCN)?
Show-cause notice is a basic and indispensable part of proceedings in the tax system and is the foundation in the matter of recovery of duty, interest and penalty. An important thing to note is that if a particular point is not raised in the show cause notice, it cannot be raised later at any of the appellate stage(s).
Show-cause notice popularly known by ‘SCN’ is a document served on a person by the department asking him to explain with reasons as to why a particular course of action should not be taken against him. It mainly provides a person who is proposed to be charged with violation of law, an opportunity to submit his viewpoint as to why he should not be proceeded against for the alleged violation.
How to respond to a show cause notice?
Attention to details
A show-cause notice should be read line-by-line and in detail to understand what precisely are the allegations which you are being asked to explain or provide a response to. One needs to look for the details which can give them the complete picture of the issue right from the basic details of the Assessee.
Understanding the Law
Drafting of a reply to a show-cause notice is an art. It requires regular practice of reading the law and updating with the circulars, notifications, trade notices, etc along with references to landmark judgements pronounced by various judicial fora. The notice will contain the laws violated and would demand a reply based on such violations.
Cover all the concerns
A show cause notice has to be replied every paragraph wise to avoid missing out on any contentions raised by the department as that would mean accepting of charges. Hence it is really important to cover all the points while drafting. References to precedents acts as an added advantage to highlight a particular point.
