what is A RERA ComPlaint?
RERA Stands for Real Estate Development Authority. A RERA complaint can be filed by any home buyer against the builder, developer or agent if the buyer’s rights are violated or any provisions of the Act are contravened. The Real Estate sector’s residential and commercial subdivisions are protected by the Real Estate Act (Regulation & Development), 2016. RERA Act aims to protect the rights and interests of the consumers and to promote uniformity, standardization of business practices and transactions in the Real Estate sector and to balance the interest of buyers and promoters by imposing certain duties on both of them and seeks to establish symmetry of information between buyer and promoter.
The RERA Act provides for establishment of a specialized body in each State for resolution of disputes related to Real Estate. The aggrieved party, either the promoter or the real estate agent or the Buyers can file an online complaint under RERA for contravention of the provisions of the Act or for the non-performance of obligations mentioned under the Act before the Authority.
Benefits of filing a rera complaint
Quick and Easy Process
Online filing has made the process of filing complaints quicker and easier rather than going through the lengthy process of court filings
Avoid delay in possession
If there is any delay in possession of the property, the buyer can file a complaint against the builder to expedite the possession of property
False Advertisement
A buyer can file a complaint against the developer / promoter / endorsers if he was misled by false advertisements on the basis of which he/she decided to deposit a sum with the promoter. One can file a complaint if a builder/ developer has not updated details regarding the project including project plan, layout, and government approvals on the RERA website.
