What is a Trademark Renewal?
In India, a trademark expires after 10 years. However, it can be renewed every 10 years so that it lasts indefinitely. Trademark Renewal in India can help you keep your trademark perpetual and permanent as there are no restrictions on how many times and for how many years you wish to keep your trademark status active and registered.
The registrar has kept a wide window for Trademark renewal beginning from 6 months before the expiry. In case you forget to renew it, the registrar sends you an official notice about the same to your registered address before the date of expiry. In case if you still do not renew the trademark before expiry, then the registrar advertises its intent to remove the trademark in the Trademarks Journal. A trademark can be renewed between 6 months to 12 months after its expiry after payment of a fine through a process called restoration.
Benefits of Trademark Renewal:
Legal Protection
Renewal of trademark makes impossible to claim rights over your trademark through frivolous litigation. It provides seamless legal protection to your trademark without any chances of litigation.
