      What is Certificate of Origin (COO)?

      A Certificate of Origin (COO) is a certificate, which identifies the country of manufacturing of any goods or a particular commodity. Additionally, it carries many other points of information including product details, its destination and the countries of export. It is a one of the necessary instruments for export or cross-border trades, as agreed upon by treaties by nations and trade agreements.

      Who Issues a Certificate of Origin (COO)?

      The Indian Chamber of Commerce and Trade Promotion Council of India, both can issue a Certificate of Origin. This certificate is a proof that the commodities or goods exported are of Indian origin. For claiming export incentives in India, exporters need to prove that the goods being exported are of Indian Origin. Numerous Certificates of Origins are issued around the world to facilitate trade and commerce worldwide.

      This Certificate of Origin is duly notarized and signed by the exporter with a permanent indemnity bond on a non-judicial stamp paper of INR 10. The certificate must also be signed and stamped by the Chamber of Commerce or any other authority with such qualification.

      Types of Certificates of Origin (COO)

      There are two kinds of Certificate of Origin that Chambers of Commerce may issue:

      Non-preferential Certificate of Origin:

      This type of Certificate of Origin states that the goods being exported/imported are not given any preferential tariff treatment and the due duties must be levied upon the goods that are being moved.

      Preferential Certificate of Origin:

      This type of Certificate of Origin is given towards goods that are subject to preferential tariff treatment in the payment of duties. These duties may be a reduction of the normal tariff, or it also may be a complete exemption of the tariffs. Such a situation arises when two or more nations reach a trade agreement entailing such exemptions when goods are exported or imported between these nations.

      What is the Importance of Certificate of Origin (COO)?

      Customs Clearance:

      If the goods, exported/imported do not come with a Certificate of Origin, the concerned Customs officer tasked with inspection of goods will not allow the goods to leave the customs custody. The Certificate of Origin is used by the Customs officer to determine the duties and other customs liabilities that have to be paid.

      Bilateral and Unilateral Agreements

      Certificate of Origin plays a vital role in the international trade between countries. As per the government policies of each country time to time, and the bilateral and unilateral business agreement between countries, the import duty may be exempted under the specified goods from particular countries. Or as per the availability and consumption goods, certain commodities are imposed import duty to control the import of such goods. Additionally, duties are levied against the goods importing from certain countries because of political policies.

      Identification illegal imports/exports

      The Certificate of Origin also helps the Customs Department of India to check whether the goods being imported in to India or exported from India are illegal.

      Export Incentives

      The government of India provides many export incentives for goods that are manufactured in India and thereby exported to foreign countries. A certificate of origin is very important to justify that the goods being exported are made in India.

      Generally, yes. Your importer will usually tell you the type of Certificate of Origin required by him. The Certificate of Origins could be broadly classified under two categories.
      – Certificate Of Origin (Preferential): Preferential Certificate of Origin as Certificate for Exports for Textile Quota (under MFA), GSP etc. are issued by designated Government Offices.
      – Certificate Of Origin (Non-Preferential): For most of other countries Non-Preferential Certificate of Origins are required and that are issued by Chamber of Commerce & Industries.

      No. Only bodies authorized by DGFT, Union Ministry of Commerce and Industry can issue Certificate of Origin. It is important to know which Office/ Chamber of Commerce can issue the Certificate of Origin.
