What is SCOMET ITEMS?
“SCOMET Items” stands for Special Chemicals, Organisms, Materials, Equipment and Technologies (SCOMET). It is a terminology used for dual use items i.e., these SCOMET items can be used for both civilian and military applications. As per India’s Foreign Trade Policy, the export of SCOMET Items is either prohibited or permitted under a license. These licenses should be obtained from the Directorate General of Foreign Trade (DGFT). All the applications for the export of SCOMET items are reviewed by Inter-Ministerial Working Group (IMWG) in DGFT purely on the basis of merit. Once the case is approved by IMWG, the license to export the requisite SCOMET item is issued to the exporter.
Criteria considered for approval of SCOMET Items:
A declaration regarding the end-usage of the SCOMET items has to be submitted stating to the DGFT.
A thorough check of the end use of the application is carried out before the approval is given for the export of SCOMET Items. This exercise includes verification of the credentials of the end-user, checking the credibility of declaration the end use application of the export of SCOMET product, examining the potential of item or technology to contribute to end uses that are not in conformity with India’s national security or foreign policy goals.
Assessment of the risk that the exported items will fall into hands of terrorists, terrorist groups, and non-State actors.
Applications for transfer of “Technology” for any item on the List will be considered as an application for export of the item itself.
Licenses for export of items in SCOMET List solely for purpose of display or exhibition shall not require any end-use or end-user certifications. Additionally, Licenses for export of items in this List for display or exhibition abroad are subject to a condition of re-import within a period not exceeding six months.
Export or attempt to export in violation of any conditions of license shall invite civil and/or criminal prosecution.
